Penguins PR provides public relations, SEO, personal branding, CRM setup, podcast production, web design, and related digital marketing services. Service descriptions on our website are for informational purposes and may not include every detail of service delivery. Specific deliverables, timelines, and terms are outlined in individual service agreements or proposals provided to clients upon engagement. In the event of any conflict between these Terms of Service and a specific service agreement, the service agreement shall prevail.

When engaging our services, you agree to: - Provide accurate and complete information about your business and goals - Respond to communications and requests for approvals in a timely manner - Provide access to necessary accounts, platforms, and materials as required - Not misrepresent your identity, business, or qualifications - Comply with all applicable laws regarding your business and marketing activities - Respect intellectual property rights of Penguins PR and third parties Delays in providing required materials or approvals may impact project timelines. Penguins PR is not responsible for delays caused by client non-responsiveness.

Payment terms vary by service type: - One-time packages: Full payment is due at the time of purchase - Monthly retainers: Billed at the start of each billing cycle - Custom projects: Payment schedule as outlined in the service agreement All payments are processed securely through Stripe. We accept major credit cards and ACH bank transfers. Late payments may result in service suspension. Accounts more than 30 days past due may be sent to collections. A 1.5% monthly late fee may apply to overdue balances.

Cancellation policies: - Monthly plans: Cancel with 30 days written notice. No cancellation fees. - One-time packages: Eligible for a full refund within 30 days if deliverables have not been started. - Custom projects: Refunds are prorated based on work completed at the time of cancellation. To cancel, send written notice to julianbtv@gmail.com. Cancellation is effective upon acknowledgment by our team. We may terminate services immediately if a client violates these terms, engages in fraudulent activity, or behaves abusively toward our team.

Ownership of work product: - Client materials: You retain ownership of all materials you provide to us (logos, photos, content, etc.) - Deliverables: Upon full payment, clients receive ownership of custom deliverables created specifically for them (website designs, content, graphics) - Templates and tools: Penguins PR retains ownership of proprietary templates, tools, processes, and methodologies used in service delivery - Website content: All content on penguinspr.com (text, images, design, code) is owned by Penguins PR and protected by copyright law You may not reproduce, distribute, or create derivative works from our website content without written permission.

While we have a strong track record of delivering results, we cannot guarantee specific outcomes. Marketing results depend on many factors including market conditions, competition, product quality, and client cooperation. Testimonials and case studies on our website represent individual results and are not guarantees of future performance. Past results do not guarantee similar outcomes. We do not guarantee placement in specific publications. Media placement depends on editorial decisions by independent journalists and editors.

To the maximum extent permitted by law, Penguins PR shall not be liable for: - Indirect, incidental, special, or consequential damages - Loss of profits, revenue, data, or business opportunities - Damages arising from third-party actions or services - Service interruptions or errors beyond our reasonable control Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the legal theory under which liability is asserted.

You agree to indemnify and hold harmless Penguins PR, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: - Your use of our services - Your violation of these terms - Your violation of any third-party rights - Content or materials you provide to us - Any misrepresentation by you regarding your business or qualifications

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of San Diego County, California.
